Will I be paid if I lose time from work?

Entitlement to be paid under the workers’ compensation law is dependent upon whether or not you were working your regular hours parlayed with what the opinion is from the authorized treating physician. If you are taken off work and put on what’s called a Temporary Total Disability (TTD) capacity, then you should be paid two-thirds of your average weekly wage, subject to a maximum compensation rate. If you have light duty restrictions, you are also entitled to be paid.

When the authorized physician has indicated either that you cannot work, or that you can work with restrictions, the amount that you should be paid will depend upon the restrictions or the complete out of work status that you have at the time, and for the period of time that you are on that status. You should consult an attorney to determine which is the appropriate status for the time frames in question.
